Acceptance of Terms

These Terms of Use ("Terms") form a binding agreement between you and ReplyCash ("ReplyCash", "we", "us", or "our") governing your access to and use of the ReplyCash website, mobile experience, and related services (together, the "Platform"). By creating an account, browsing available reply tasks, or completing any task through the Platform, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference.

If you do not agree to these Terms, you must not access or use the Platform.

Eligibility

To use ReplyCash, you must:

• Be at least 18 years old;
• Be a resident of Kenya with a valid, registered M-Pesa account in your own name;
• Provide accurate, current, and complete information when creating your account;
• Have the legal capacity to enter into a binding agreement under Kenyan law.

ReplyCash may request identity verification at any time and may refuse service, suspend, or close accounts that do not meet these requirements.

Your Account

You are responsible for maintaining the confidentiality of your account password and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. Each person may hold only one ReplyCash account; creating multiple accounts to claim additional free tasks, bonuses, or referral rewards is a violation of these Terms and may result in forfeiture of earnings and account closure.

The Platform & Reply Tasks

ReplyCash operates a platform that lists available online reply tasks — such as chat replies, customer-service responses, surveys, translation, and data entry — submitted by ReplyCash or by partner businesses. When you accept and complete a task in accordance with its instructions, you earn the payout amount stated for that task at the time you accepted it.

ReplyCash reserves the right to:

• Review, moderate, or reject submitted task content that is incomplete, low-quality, fraudulent, or that violates task instructions;
• Limit the number or type of tasks available to any individual account;
• Change, remove, or replace available tasks at any time without notice.

ReplyCash is a platform that facilitates access to paid tasks; it does not guarantee a minimum number of available tasks, a minimum income, or continuous availability of any particular task type.

Payments & M-Pesa Payouts

Earnings are credited to your in-app balance once a submitted task has been approved. Approved balances can be withdrawn to your registered M-Pesa phone number, subject to any minimum withdrawal threshold displayed on the Platform. ReplyCash uses commercially reasonable efforts to process payouts promptly, but payout timing may depend on Safaricom or third-party payment-processor systems outside our control.

You are responsible for ensuring the M-Pesa phone number linked to your account is correct and belongs to you. ReplyCash is not liable for payouts sent to an incorrect number you provided, or for delays caused by your mobile network operator or Safaricom.

Any tax obligations arising from your earnings on ReplyCash are your responsibility as the recipient of that income.

Subscription Plans

ReplyCash may offer optional paid subscription tiers (such as Pro or Business) that provide benefits like priority access to higher-paying tasks or faster payouts. Subscription fees are billed as disclosed at the time of purchase. Except where required by law, subscription fees are non-refundable once a billing period has begun. You may cancel a subscription at any time, effective at the end of the current billing period, through your account settings or by contacting support.

Prohibited Conduct

When using the Platform, you agree that you will not:

• Submit false, plagiarized, AI-generated where prohibited by task instructions, or low-effort responses to reply tasks;
• Use bots, scripts, emulators, or automated tools to complete tasks or interact with the Platform;
• Create more than one account, or create an account on behalf of someone else without authorization;
• Attempt to manipulate, exploit, or interfere with the Platform's systems, security, or payout mechanisms;
• Use the Platform for any unlawful purpose, including money laundering or fraud;
• Harass, threaten, or abuse ReplyCash staff, partner businesses, or other users;
• Reverse-engineer, scrape, or copy the Platform or its content except as permitted by law.

Violation of this section may result in immediate suspension or termination of your account and forfeiture of unpaid balances associated with the violation.

Intellectual Property

The Platform, including its design, logos, text, graphics, and software, is owned by ReplyCash or its licensors and is protected by Kenyan and international intellectual-property law. Except for the limited license to access and use the Platform for its intended purpose, these Terms do not grant you any rights to ReplyCash's intellectual property. Content you submit while completing a task (such as a written reply or translation) may be used by ReplyCash and the relevant partner business for the purpose the task was created for.

Suspension & Termination

You may close your account at any time by contacting support. ReplyCash may suspend or terminate your access to the Platform, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive conduct, or if required to do so by law. Upon termination for cause, any pending unpaid balance associated with violating activity may be forfeited; approved balances unrelated to the violation will still be paid out where legally required.

Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. ReplyCash does not warrant that the Platform will be uninterrupted, error-free, or secure, or that any specific volume or type of paid task will be available at any given time.

Limitation of Liability

To the maximum extent permitted by Kenyan law, ReplyCash and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of income, profits, or data, arising from your use of or inability to use the Platform. ReplyCash's total aggregate liability to you for any claim arising from these Terms or the Platform will not exceed the total amount ReplyCash paid to you through the Platform in the three months preceding the claim.

Indemnification

You agree to indemnify and hold ReplyCash harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Platform, or your violation of any law or third-party right.

Governing Law & Disputes

These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Platform will first be addressed through good-faith negotiation with our support team; if unresolved, disputes will be subject to the exclusive jurisdiction of the courts of Kenya.

Changes to These Terms

We may revise these Terms from time to time. If we make material changes, we will notify you by email or through a notice on the Platform before the changes take effect. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. The "Last updated" date at the top of this page shows when these Terms were last revised.
